Terms and Conditions

Nassau National Cable warrants that all products, unless otherwise specified by a mutual written agreement, will conform to the detailed specifications in the purchase order and will be free from performance-impairing defects.

This warranty is the exclusive warranty provided by Nassau National Cable. We will repair or replace defective products as per the manufacturer’s warranty period, but no longer than one year. For details about warranty length, customers should request this information in writing from Nassau National Cable at the time of purchase.

This warranty supersedes all other warranties, express or implied, and limits Nassau National Cable's liability to the purchase price of the products. It does not cover labor costs. Modifications, improper installation, or misuse voids the warranty.

Nassau National Cable is not responsible for:

1. Issues not reported within the warranty period or 12 months from the date of shipment, whichever is sooner.
2. Damages from alterations, incorrect usage, or unusual conditions.
3. Products damaged in transit or by other non-fault conditions.
4. Installation costs incurred before defect discovery, or attempts to repair alleged defects.
5. Costs related to the removal and reinstallation of faulty products.
6. Damages that are not directly and solely caused by defects in materials or craftsmanship.

Nassau National Cable may initiate legal proceedings related to any debt collection in competent courts of their choosing, and the purchaser consents to the jurisdiction and venue of these courts.

Goods are shipped FOB destination, with Nassau National Cable reserving the right to ship via the carrier of our choice. The unloading of materials at the point of destination shall be the sole responsibility of the buyer.  Liability is transferred from Nassau National Cable at the time the load is picked up by the carrier.

Any tax or other governmental charge upon the production, sale, shipment, or use of the product which Nassau National Cable is required to pay or collect from Buyer shall be paid by Buyer unless, prior to shipment, Buyer has furnished Nassau National Cable with a tax exemption certificate acceptable to the appropriate taxing authority. Exemptions from taxes or taxes charged are subject to reassessment by taxing authorities, and exemptions made, or taxes charged to you, are without prejudice to our right to recover from you at any subsequent date, taxes improperly exempted or assessed.

Items sold are non-cancellable and non-returnable. Nassau National Cable does not allow returns unless the delivery receipt clearly notes damage or the wrong material. Once goods are signed for by the driver, the buyer cannot return the item.  In certain cases Nassau National Cable will all Return authorizations only with prior written approval.

All custom lengths that are not a multiple of 1000FT and specialty custom manufactured materials are non-cancellable and non-returnable unless the delivery driver's receipt is clearly notated that it is the wrong material or it is rejected upon delivery, or Nassau is advised prior to delivery of a pending rejection in writing prior to delivery. Once the goods are signed for clear to the driver, the buyer cannot return the item.

Prices quoted by Nassau National Cable in quote format (PDF) or (informal email) are exclusive of applicable taxes and are subject to change without notice until the item is purchased. Any statement or advice (including but not limited to advice regarding the quantity of goods necessary for a particular job, or the suitability of a particular product for a particular use) is provided solely as a courtesy to the purchaser and is not guaranteed. No such statement or advice shall subject Nassau National Cable to any liability whether based on contract, warranty, tort (including negligence), or other grounds.

Payment for items purchased by Purchaser is due on or before the due date shown on each invoice. If paid on or before the date shown on the invoice, the applicable cash discount, if any, shown on the invoice may be deducted by Purchaser when making such payment. If payment is not received by the first of the month following the due date shown on the invoice, an amount equal to the percentage rate shown on the invoice shall be charged on the unpaid balance of the invoice as a late payment service charge no less than 2% per month.

In the event it is necessary for Nassau National Cable to employ a collection agency or an attorney or attorneys or incurs other expenses it may deem necessary to enforce or protect its rights hereunder or to collect damages for breach of the terms and conditions set forth herein, Purchaser hereby agrees to pay to Nassau National Cable those collection fees, attorneys’ fees, and expenses so incurred by Nassau National Cable.

Buyer assumes responsibility and liability for any claim or action based on or arising out of injuries, including death, to persons or damages to or destruction of property, sustained or alleged to have been sustained in connection with or to have arisen out of or incidental to the performance of this Agreement by Buyer, its agents and employees, and its subcontractors, their agents and employees, regardless of whether such claims or actions are founded in whole or part upon alleged negligence by Nassau National Cable, Nassau National Cable's representatives, or the employees, agents, invitees, or licensees thereof. Buyer further agrees to indemnify and hold harmless Nassau National Cable and its representatives, and the employees, agents, invitees, and licensees thereof in respect of any such matters and agrees to defend any claim, suit or action brought against Nassau National Cable, Nassau National Cable's representatives, and employees, agents, invitees, and licensees thereof, regardless of whether such claims or actions are founded in whole or part upon the alleged negligence of Nassau National Cable, Nassau National Cable's representatives, or the employees, agents, invitees, or licensees thereof.

Nassau National Cable shall not be responsible or liable, either directly or indirectly, for any loss or damage due to delay in delivery caused by war, hostilities, invasion, insurrection, riot, the order of any competent civil or military government or by fire, strikes, lockouts, labor disputes, lack of transportation facilities, shortages of raw materials, or by any other cause whether or not of a similar nature, which is unavoidable or beyond the reasonable control of Nassau National Cable.

Nassau National Cable reserves the right to correct any clerical or stenographic error made in the preparation of quotations, orders, acknowledgments, or invoices. Corrections shall be considered as binding amendments to the original contract of sale.

If any provision or part of this agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired

Non-returnable wooden/plastic reels are used whenever possible and are normally included in the sales price of the wire.
